Looks like you pretty much said what I was going to. If it is too dark or otherwise to properly identify birds, Don't SHOOT! I have held off until better light and have forgone limits many, many times. Better safe than sorry.
p.s. SSS, your poll picture is of a bird on the ground which is not a good test for wing shooters, only ground pounders.
I am not trying to be harsh, just realistic. By all means don't give up hunting for one bad incident. People don't give up driving when they get a speeding ticket.
Here is an update. The ticket is not payable and you have to appear in court. So there is no just paying it and moving on. I'll keep you posted.
It's a misdemeanor. Usually you do have to appear on those, however, some F&G citations do have a set fee. Take my advise, plea to the prosecutor and you'll be fine.
$400. So if you shoot one set it on the end of your barrel and blow it all over the river.

You got off lucky. Good job SSS, I was afraid you were going to end up with some amount of time without a hunting liscence Sounds like you did good though. Did you cut a deal with the prosecutor or what. Tell us how you ended up handling it so if something happens to someone else in the future........
I did cut a deal. Here were the options.
She would ask for $400 and a year probation if I pled guilty. If I fought it she was going to ask for $3500, suspending my licience for 3 years, and I could have up to 18 months jail.
Which would you choose. And really $400 who cares. Shoot I blow more then that on food and crap for hunting.
