They made a big deal about the "assistants" which I do not know of one guide who ever used one. A lot of that crap is either hearsay or hunters getting confused as guides.

I have 2 guides and both have been required to have their own special - use permit, captain's license, guide license etc. An assistant is entirely separate which I do not have. My 2 guides will now apply and share 1 special-permit since they are both part time.

Got it. With the number of guide operations and guides working for guides what is the chance of drawing one of the 5 ? Any idea of total number that may apply ?

Read your own posted response-comments to the USFWS. You yourself stated 6

Then it's 100% unless others apply. If you read some of the comments there were around 15-20 on pool 9 according to one person.

So can a guide go out several hours before shooting time, set up decoys and then go back to pick up his clients? Maybe if assistant holds the spot?

Decoys can't be put out until an hour before shooting time and assistants have to stay within 50 feet of the guide. So I would say no.

How did the guides win ?

They cant hunt and shoot ducks while guiding. They lost revenue do to the 3% tax. Their assistant has to stay within 50 feet of them so they can not hold spots any longer. Guides have to now guide at least 25% of the season and keep very accurate records that must be turned in, so no more "cash days" to cut out uncle Sam.
