Major win for real estate developers and farmers. This could lead the way for increased drainage of shallow permanent and temporary wetlands throughout the US, especially in the Upper Midwest and Great Plains. It is a major loss for ducks and other shorebirds, but I suspect the affects will not seen for a few years. Nonetheless, the decision will have a negative effect on waterfowl populations overtime.

The fact there was zero dissent indicates they made the correct ruling. That doesn’t mean congress can’t get to work and strengthen the act in a constitutionally appropriate way.

Farmers will be draining wetlands like crazy now, more than they already are with the miles and miles of drain tile being put in. Crazy how the landscape has changed in the Dakotas in the last dozen years or so. Will only get worse
There are wetlands left on Ag land? The Ethanol mandate has done enough damage to destroy wetlands.

No doubt. Ethanol has been a huge loser for wildlife, the environment and financially for all but a very few.

Or the States. The States can have their laws in place that were passed via their members of Congresses who were elected.

There is wetlands left, few but some, that will undoubtedly be drained now. I can assure you the farmers in the PPR are well aware of this ruling. The glory days of duck hunting is over…it was a good run

Water should largely be federally regulated. Like waterfowl regulations, a state should be able to be more restrictive, but they should never be less. Water runs funny ways, and the paraphrased Oliver Wendell Holmes quote of “your freedom ends where my nose begins” comes to mind.

I agree 100%. The laws need to be passed/strengthened via our elected Representatives in Congress per the Constitution.
