With the definition of life vs. death (presence vs. absence of a heartbeat), per both the AMA & ABA guidelines, Roe v. Wade made elective abortion justifiable homicide once a fetal heartbeat is present. Overturning the 1973 ruling wouldn't outlaw elective abortion, rather return statutory control of such to the individual state legislatures. It would be interesting to see how Oklahoma's new law would be applied to an elective abortion practitioner from NY/CA should he/she ever cross into the state.
